Kenya citizenship and immigration act: Why politics of the day matter

The Kenya citizenship and immigration act places the power to revoke citizenship acquired fraudently or via misrepresentation of material facts on the cabinet secretary responsible. As of today, that’s the cabinet secretary of interior and coordination.

While the constitution states how such illegally acquired citizenship can be revoked, the actual revokation rests with the cabinet secretary responsible.

So, we can conclude it’s the minister responsible allowing fraudelent acquisition of Kenyan citizenship.

We can also conclude, the minister responsible is incompetent, including parliament and AG, because some policies the government is hell-bent on implementing come close if not to violating the constitution like the Ushirika plan.

I’m not a lawyer,but I understand states are obliged to accept refugees and not refoul. That means, states may not fully exercise their sovereign descrition while trying to offer refuge and comply with international law.

This means refugees or people who gain entry to Kenya under such international obligations cannot convert to citizenship unless a law is created to provide such a pathway. This is because, citizenship via marriage or long term resident ,can be argued, is a right close to 1 million refugees couldn’t attain looking at everything!!!

I rest my case, if you know you fraudently acquired citizenship, KNBS data doesn’t agree unless you take many many years to doctor every digit, which is impossible as criminals always leave traces. Furthermore,to be safe you only need to lay low.No politics.No business competition.No crime.etc

One more thing, lawyers and courts can order recounts, but that doesn’t change natural numbers.

It’s my considered opinion, Interior and national coordination should be split into 2. Interior to be strictly about interior/national security(this will solve the constant incompetence of police) and national coordination/administration be the second ministry(this will reduce the government corruption, incompetence, bureaucracy etc)
