Insurance payout during car accident

So someone was hit by a car, driver of the said car was at fault lets say drunk…
What is the usual/approximate payout/compensation by the insurance company for the person hit by the car…
The person not really injured went to hospital for treatment but claims quality of life has changed due to the accident…
Does this kind of case usually have to go through the courts for the insurance company to process the claim or how does it work…

This is better handled by your insurance with back up from your police abstract.

Edit the title…insurance payment “after”…not “during”.

You will need to go to court. Have all the necessary docs ready, police abstract, medical evaluation, and proof of loss.

The insurance company can repudiate that claim on account of the driver being drunk. You might have to sue the driver personally for compensation. We Kenyans joke too much. Drunk driving can make you poor for the rest of your life.

Definitely get a professional assessment from a trusted auto body shop or your insurance provider. They can give you a clearer idea of repair costs and whether it’s safe to drive in the meantime.

From the pics, it looks like the damage is definitely frustrating, especially since your car is so new. Whether it’s fixable or a total loss depends on the extent of the damage underneath the surface, but it’s good you’re checking it out. I’d recommend getting a professional opinion from a trusted mechanic or body shop. They can assess the structural damage and give you a clearer idea.
