Acting Inspector General of Police , Gilbert Masengeli has failed to appear in court for the sixth time in a row despite receiving multiple summons.
Masengeli on Monday sent his Deputy Eliud Lagat , the Deputy Inspector General Kenya Police Service instead to represent him at the court , explaining that he was far away in Wajir and could therefore not be able to make it to the session.
The IG was summoned to appear in regards to an abduction case involving three activists who disappeared in Kitengela on on August 19, 2024.
Masengeli failed to appear in court on September , 3 , 2024 after he informed the court that he was away attending a workshop in Mombasa.
Justice Mugambi however declined to hear the reasons for the failure to appear and insisted that IG Masengeli could not be allowed to appear virtually but instead ordered that the IG appears in person today September , 9, 2024.
However , the court by the time of publishing had not issued a directive on the way forward for the order that is likely to find IG Masengeli with offences of Contempt of Court.
BOTTOM LINE :
The Police IG is subject to the Law of the Land , just like everyone else.
He has clearly demonstrated Contempt of Court.
The Law should take it’s course as provided in the applicable Statutes.
The question is why issue a summon to him. They should also be able to get the same testimony from the deputy IG, or any senior officer in that department.
rules of evidence for starters? primary witness and shit?
and the summons was to the Ag IG, NOT his assistant, mother, girlfriend or the police sniffer dog. and he knows how court orders work, he cannot have gotten to that position without knowing!
