Yesterday i was called by a parastatal after tender valuation was done, i was the lowest bidder,
and the others were unresponsive. They plucked out my confidential business questionnaire and said
its missing but during tender opening it was there. Can PPOA really help? Anyone with experience?

It will cost you more time and money to go through PPOA to solve the issue. Plucking out your CBQ is simply a way of saying lazima utoe kitu kidogo ili upate tender
Coz it doesnt work like that. When you open the tender in front of the tender committee they check on all mandatory documents. And it was there.
How does PPOA work, isnt this way it was established to ensure transparency of the process? why do they do public tender opening if not to avoid issues like this? am just sad. Half the people during opening did not even have the requisite certification.
What did they tell you the solution was after they said its missing!

Did they pluck it in both tender copies? That’s Why its a good system to number your tender pages with manual numbering and book bind the tender. Spiral binding is an easy way for your documents to be plucked.

Anyway, write to the CEO that you are placing a complain with PPOA and he/she will most probably opt to give you the tender
Exactly, we numbered and bound it. Just talked to the procurement manager and they have cancelled the entire tender. An investigation would be good to know how they did that or i just let go and re-tender. But i feel like it will be a lost cause. They are definitely working for a specific person.
Which parastatal?
There are some parastatals like KNH where tendering is a waste of time.
and also report the case to the Ombudsman office ,Commission on Administrative Justice.Kama kulikua na foul play watatii.

I do almost 20 public tenders a month. CBQ is not checked in the tender opening. Don’t refuse to pay; only pay a Top manager ( finance, procurement).
The pages are supposed to be numbered or serialised. That way you can use PPOA Review board. Write a letter to procuring entity requesting for evaluation report after 30 days. Most people think the lowest bid must win, only to find out stupid mistakes cost you.
Note: Private tenders are even worse.
Also note, the procuring entity can cancel a tender at any time.
I can remember winning a tender ( total profit KES 5,000,000 , it was a consultancy ). I went to Mombasa spent tooooo much. After 3 weeks, I came back to find the tender has been re-tendered! We did the tender again, I even reduced my price! Still, re-tendered again! And every time they change the technical details. Now what shocks me, Kenya Revenue have never done what the tender document was supposed to do, since 2015!
