in some jurisdictions, lawyers would be camping in that hospital 24/7 , offering pro bono to the victims of this illegal detention, human rights activist will be on tow too. these incidences are very rampant in .ke, and we seem to have accepted them as a way of life.
My mum is a lawyer and we talk about this often. You need doctors and staff to be able to testify against the same hospitals that they practice at to accertain claims and that is where cases go cold. Doctors will never agree to mudsling when you want to sue the daylights out of a facility and they are forced to do out of court settlements.
this one is a case of illegal detention by the hospital, hii hata watchman can testify, all is needed here is the hospital management to testify under oath.
the essence of suing in civil a civil case , is to get out ot court settlement, but in this case, that detention is on the criminal side.

Fear in the sense that if a doctor testifies and a hospital is fined, the doctor will be a marked man. Hatafanya job kwingine, his fellow doctors will shun him, etc. We had a case where a cousin(who was giving birth through cs) was overdosed through anaesthesia, the pathologist that did the postmortem saw exactly what the cause was but there was no way he would finger the culprit. Instead in the heat of the moment, the fool made us pay him an additional 10k to go and do tests and growths he chopped off from some organs of her corpse. He never brought the report claimed to be busy after the funeral and sent a fellow doc to ask why we need a report anyway since we already buried her.
