"Some ten suspected adherents of the outlawed Mungiki sect nabbed while allegedly taking oath on Sunday along River Chania in Nyeri were today set free by court.

Principal Magistrate Desderious Orimba freed the suspects after the prosecution successfully applied to have the charges against them dropped for lack of evidence linking them to the alleged offense.

The young men, Isaiah Kinyua, Alex Kabira, Kennedy Kanyoro, Anthony Weru, Peter Mwai, Michael Kahumbu, Jackson Nyaga, Henry Mwangi, Joseph Wachira and Timothy Nderitu were first arraigned in court yesterday.

The prosecution however applied to be granted more time to complete investigations.

Investigating Officer Onesmus Kyalo told the court that they were to be charged with the offense of unlawful assembly, saying the matter was of national interest as the group was a threat to the security of the country."

What fuckery is this?
It isn’t even their defense that asked for the charges to be dropped but the prosecution?
Those guys should go ahead and sue for wrongful incarceration.

:D:D:D the eyes are indeed shining! And here I was thinking it was just a random phrase from jirani

i thought police can detain you for 24 hours if they deem you suspicious. they then went to court and applied to hold them for seven days, were allowed, returned after a day and asked they be released unconditionally…
