Article 138 (c) of the constitution:

After counting the votes in the polling stations, the Independent Electoral and Boundaries Commission shall tally and verify the count and declare the result.

Chebukati is the Returning Officer of the Presidential results, but that doesn’t give him the mandate to tally and verify the results alone.

It’s like how in a jury court of law, the jury can decide who is guilty or not guilty, but it’s the judge who can declare the verdict.

The IEBC set up is structured in a similar way. Chebukati’s role is oversight and declaration of the president elect, but he can’t declare the winner without a consensus from the committee.

The IEBC does not only refer to the commissioners but includes the staff that were involved in the verification of the results. Hao watu ulikuwa unaona hapo katikati were the people conducting that exercise of tabulating and verification. As far as things stand then, the iebc did its work fully.

No, the commission isn’t the committee…

Even at the polling station, the law is that the Commission shall tally, verify and announce results. So the commission is everyone hired by the IEBC.

Of all the commissioners, only Chebukati has a defined role in the tallying, verifying, and announcement of the results.

The announcement of verified results is at the Chairman’s discretion. If he’s satisfied that the remaining constituencies can’t overturn an election, then he can declare the winner too.

The court also ruled that IEBC chairperson as an individual cannot correct, vary, confirm, alter or modify the results that are electronically transmitted to the national tallying center from the constituency tallying center.

His job is just to tally and declare the president-elect based on what was announced at the constituency tallying center. He should not alter or change anything.

Any discrepancy in the forms can be revisited by the Supreme Court.

Or if there was discrepancy in the total votes cast. For instance, if the total votes cast of the president exceeds the total votes cast of the governor, senator, women rep, mp and mca in some constituencies.

No ,yeye asome total ya form 34 A’s without altering anything .That is the maraga led supreme court judgement verdict.
He can prepare a report where the form 34 As has issues and advice the supreme court accordingly

Navy seal, consider this tho’ … a scenario where RAO forces a repeat election through the supreme court, wether the concerns are legitimate or not … any political scientist will tell you that it will be disastrous for him. The odds this time are just against him. Pure and simple. The best and smartest thing is to let this one slide. He was beaten legit or not … hands down. He slept on the job … n he got outsmarted.
