They can. It’s part of the NATO accords. Once you enter you sacrifice sovereignty of your bases to the US for use at any time even without prior notice.
Same applies with Kenya’s bases. Once you sing the agreement the US does not have to ask permission. A good example is gunatanamo bay. The US signed an agreement with Cuba that is in effect today even though Cuba and America are enemies.
They can be courteous but they don’t have to be

The sovereignty of the spanish govt supersedes the bilateral agreement. All entry gates are operated by Spanish security forces . While U.S. Navy teams provide security inside the base, they cannot move cargo or personnel in or out through the gates without Spanish approval unless they want to start a military dogfight.
It does not. Agreements between sovereign countries are binding and can be enforced peacefully or forcefully. For example our border with Uganda and all borders of countries are sovereign agreements. We enforce them peacefully but like in Russia and Ukraine they’re being enforced forcefully.
It’s up to parties involved to decide which means to enforce an agreement. In short, America can enter into Spain legally and Spain can attempt to stop it illegally as is their right to do so.
International law is basically agreements based on might and civility. Both are legal and they can fight legally and declare a truce when they’re done.
In short, America has the upper hand
