Lawyer Apollo Mboya has moved to court seeking to restrain the government from advertising its achievements in its new delivery portal.
The lawyer wants the court to declare that the use of public resources to launch and maintain the portal contravenes the Elections Offences Act, 2016 and is therefore irregular and illegal.
He does not want the government to advertise projects undertaken across the country in the last four years.
President Uhuru Kenyatta launched the portal on April 10 saying his primary duty is to create a conducive environment for Kenyans to realise their full potential, improve lives, and transform the country.
“My vision is to have an all-inclusive and stable Kenya where every single Kenyan feels they have a caring government that inspires hope and not negative ethnicity,” he said.
On April 13, the IEBC warned public servants against using state resources in their campaigns ahead of the August 8 polls.

The commission said such practices are against provisions of Section 14 of the Election Offences Act.
Chairman Wafula Chebukati said in a statement that those who violate the law will be fined Sh2 million or jailed six years.
“Be notified that persons who fail to comply with the provisions of this law commit an offence and are liable on conviction.”
He added that the commission or its agents will impound any state resources unlawfully used in campaigns.
The electoral agency asked MP, governor, deputy governor and MCA aspirants to declare state assets assigned to them. The notice did not include the President and Deputy President.
“Those who wish to participate in the elections should provide a list of the said facilities to IEBC by May 2,” Chebukati said.
