A Migori man was sentenced to life imprisonment on Wednesday after he was found guilty of trafficking 155 rolls of bhang.

Emmanuel Chacha was charged with trafficking the bhang worth Sh23,250 at the Likoni Ferry channel in Mombasa on May 14.

Chacha had pleaded guilty to the charge.

According to the prosecution, the man was arrested after his bag was screened ahead of crossing.

State Counsel Lilian Fundi said security officers found the rolls after thoroughly searching the bag.

The government chemist confirmed that the suspect had bhang.

But Chacha, who confessed to the crime but noted that this was the first time he had ferried bhang from Migori, pleaded with the court to forgive him.

He said his conscience did not allow him to lie to the court.

“I had been convinced that if I ventured into that business, I would escape poverty. That was my first time in Mombasa,” he said.

While sentencing him, Senior Principal Magistrate Edgar Kagoni said people like Chacha should be locked away from society so youths are protected.

He said drugs have made youths turn into criminals so traders must be stopped.

“The likes of the accused have rendered youths useless and dysfunctional. It is the court’s duty to protect them from people like you,” he told Chacha.

Kagoni said the sentence will serve as a lesson to people who think Mombasa is a dumping site for narcotic drugs.

“Drug dealers targeting Mombasa will think twice,” he added.

A fucked up judicial system

Maraga’s very independent courts.

Prison is a poor man’s vacation. Take that to the bank. The only reason why those who are in prison are there is because they were broke by the time they were being sentenced. If you have a liquidity of above 500 mil, you are pretty much safe from being jailed hata ikiwa murder. You can buy your freedom.

Hahaha, huyo judge inakaa alitombewa bibi na mfurutaji fangi, that’s too personal. Let those who believe that “honesty is the best policy” bullshit learn from our friend Chacha. Ata ukipatikana red handed, ata kama cameras zinaroll, kataa!! It is up to the state to prove beyond reasonable doubt that it was you who commited the crime, and not your “long lost twin brother”.

What’s wrong with this name Chacha?

The sentence was too harsh

The DPP has certainly done their job here. We can’t have it two ways. The DPP (local prosecutor) presented a case and the judge issued a sentence. This was not bhang used for personal consumption, this was a trafficking case. You could strike bhang, insert heroin, cocaine etc. The type of drug for as long as it remains illegal should have no bearing on the consequences. Kenyans are receiving and serving life sentences in Malaysia, Philippines, China for drug trafficking while others barely dodged death sentences, others have died mysteriously in prisons as far away as Brazil. However no one protested that those countries were wrong to convict them except when the same is done in Kenya, a haven for impunity.

The sentence however does seem harsh, the convict said he was a first time offender, he also confessed to the crime and showed remorse, the value of the drugs was also low. All these factors should have been seen in mitigation.

Would we complaining as much if we struck out the word bhang and replaced it with corruption? Let’s encourage those who uphold the sanctity of the judicial system. Magistrate Kagoni may have been overzealous but we should applaud his action but critique the excessiveness of the sentence. Unfortunately for strictly observing the rule of law, his promotion to a High Court judge may be indefinitely delayed.

As we complain about this case (where there was no actual victim), there are cases where persons died and the perpetrator will likely get away.

If we want to legalise bhang as a society, lets lobby MPs or put it to a referendum but until then, the law is the law. Kabura and Co. will not get away if we have a judiciary and prosecutor as zealous as those in this case. However let’s not forget that even if Kabura has been locked up, the kingpin would still have gotten away and their election war chest would likely have remained unscathed. For that we need effective organised crime laws.

I sympathise with Chacha because people who should be rotting in jail are riding around in air conditioned Toyota Prados in the back left.
The reason why they are not rotting in jail is corruption. I even gave an example of Kabura who told Kenyans she walked away with gunny sacks full of stolen NYS money and she is still a free woman.
Justice system seems to work extremely well on people like Chacha but suddenly can’t work when an MPig like Alfred Keter is caught red handed.
