Senators Who Tried to Save Sonko

16 senators out of 45 tried to save Nairobi Governor Mike Mbuvi Sonko from being impeached during the senate hearings on Thursday, December 17.

Sonko becomes the second governor to be impeached by the Senate following former Kiambu governor Ferdinand Waititu in January 2020.

The Senate upheld the County Assembly’s decision to impeach the former Nairobi Senator on Thursday night following a two-day hearing.

[B]The 16 were senators; Samson Cherargei (Nandi), Aaron Cheruiyot ( Kericho), John Munyes (Turkana), Susan Kihika (Nakuru), Kithure Kindiki (Tharaka Nithi), Christopher Lang’at (Bomet), Ltumbesi Lelegwe (Samburu) and Mary Kitany (Meru).

Others include; Anuar Loitiptip (Lamu), Mohamed Maalim Mohamud (Mandera), Philip Salau Mpaayei (Kajiado), Kipchumba Murkomen (Elgeyo Marakwet), John Nderitu (Laikipia), Olekina Ledama (Narok), Enoch Kiio (Kitui) and Juma Wario (Tana River).[/B]

27 of the senators voted against Sonko while two abstained (Makueni’s Mutula Kilonzo and Nairobi’s Johnson Sakaja).

Sakaja abstained in accordance with the senate standing orders that prevent a senator to vote in the county where a governor is being impeached unless it’s the vote is a tie.

“Voting is optional. If you want to vote well and good, if not, then it is still okay,” senate speaker Kenneth Lusaka had stated.

[B]The row between President Uhuru Kenyatta and his deputy William Ruto resurfaced during the voting process.

Allies aligned to Kenyatta and ODM leader Raila Odinga voted to uphold the motion while those who are purported to be neutral teamed with DP Ruto’s camp to overturn the motion.[/B]

The decision followed two-day proceedings with Sonko being accused of gross misconduct, violation of the constitution, crimes under national law, and abuse of office. Senators voted on each allegation fronted against Sonko.

Sonko’s impeachment was gazetted on Thursday, minutes after the senate had cast their vote.

Nairobi County speaker Benson Mutura will be taking over the role of acting governor for 60 days before a by-election is conducted.

Even before dust settles on the impeachment of Mike Sonko, intense lobbying and behind-the-scenes maneuvering to find the next Nairobi governor are on.
Several people have thrown their hats in the ring, even as names of politicians and technocrats are floated as possible candidates in the by-election expected to be held 60 days after the swearing-in of acting Governor Benson Mutura today.

Former Starehe MP Margaret Wanjiru, 2013 presidential candidate Peter Kenneth and Building Bridges Initiative (BBI) national secretariat co-chairman Dennis Waweru are among the politicians said to be eyeing the seat.
Businesswoman Agnes Kagure, former Nairobi City Council Clerk Philip Kisia and former Kiambu Governor William Kabogo are also interested in the coveted position.
Other politicians mentioned are Nairobi Senator Johnson Sakaja and Mr Nickson Kiprotich, who sources said is Deputy President William Ruto’s preferred choice.

Sonko on the other hand has moved to court to challenge the decision by the Senate to uphold his removal from office by the city-county assembly.

Through lawyers Evans Ondieki and Wilfred Nyamu, the ousted governor Monday wanted the court to stop the swearing-in of the County Assembly Speaker Benson Mutura as the acting governor. But the prayer was overtaken by events after Mr Mutura took the oath and assumed office in the morning.

The development forced the lawyers back to their chambers to amend the petition, in which they argue that the Senate was biased in the impeachment motion and that it “applied the political doctrine instead of the law and the Constitution”.

Another argument is that the Senate violated the doctrine of legitimate expectation by ignoring pleadings and submissions made by Sonko.
