Repeal 162

The High Court, today at 1430hrs will make a ruling whether to repeal section 162A and 162C of the constitution on LGBTQ rights.

A landmark ruling for the concerned and non-concerned parties. The whole world is waiting.

I have always been against making homosexuality and lesbianism legal in Kenya, but as I stated it here before, it’s a discussion Kenya cannot avoid, owing to its free democratic space. 1430hrs it is!

There is always a hidden clause somewhere in law that will make a mockery of this ruling. We are domed

If the Repeal goes through, the Western media aka BBC, CNN,NYT FOX NEWS,ALjazeera will be all over with articles praising Kenya for such a move…It has always been their wish that this happens…Remember Obama’s visit to Kenya, one of his main agenda talks was this one…Remember Uhuru’s interview with CNN…80% of the interview revolved around the same…Remember Richard Quest recent visit to Kenya where he openly said he is gay…This is the Western Countries driven agenda, not our agenda…I won’t be surprised if it actually goes through!

How can the high court repeal a section of the constitution? Do you even know what you’re talking about?

Your post is wrong and misleading for two reasons. No, three reasons.

  1. You cannot challenge the legality or validity of any provision of the constitution of Kenya, 2010 in any court.

Read Article 2.

(3)The validity or legality of this Constitution is not subject to challenge by or before any court or other State organ.

  1. Article 162 of the constitution deals with the system of Courts in Kenya.

Article 162:-
(1) The superior courts are the Supreme Court, the Court of Appeal, the High Court and the courts referred to in clause (2).
(2) Parliament shall establish courts with the status of the High Court to hear and determine disputes relating to-

(a) employment and labour relations; and
(b) the environment and the use and occupation of, and title to, land.

(3) Parliament shall determine the jurisdiction and functions of the courts contemplated in clause (2).
(4) The subordinate courts are the courts established under Article 169, or by Parliament in accordance with that Article.

  1. The Constitution of Kenya, 2010 does not have a Section 162A.

He should be talking about Section 162 of the Penal Code, which outlaws sodomy.
