In one way or the other, the ruling undermines the role of IEBC Chairman as the National Returning Officer. You have to understand that the CROs are just temporary employees and can be bought to manipulate results.

Really, I thought they are employees, si IEBC maintains constituency offices all year round
The chairman(plus the entire commission in Nairobi) has no capacity to audit the results from all the constituencies before announcing them. Calling them “provisional” is of no use.
If anybody doubts the results announced by a returning officer, he or she can file a petition. It would be easier to audit individual constituencies as opposed to the Bomas tallying center.
They are provisional until they are verified with Register. Declaration of Presidential Results is the mandate of the IEBC chair not some 290 sub-chairs scattered everywhere in the country

It is practically impossible for the chairman/commission to verify all the results from the 290 constituencies. that is why they have hired the RO to act on their behalf and each presidential candidate has agents on the ground to verify the announced results. The so called tallying at Bomas was useless.
Really, How long does it take to compare the votes cast with the registered votes to ensure there are no excesses?
National tallying and announcement of the winner will still be done by IEBC chairman. What was in contention was whether constituency results at the constituency level were subject to alteration by the commissioners at the top.
Justice Tunoi of the supreme court was also bribed and manipulated, so it doesn’t matter what level you’re in.
