High Court judge Kiarie Waweru threw out the case on Monday with a cost of Sh12 million - Ojaamong, the returning officer and the IEBC will get Sh4 million each.
Petitioner Peter Odima had argued that Ojaamong used county resources and staff to campaign.
Odima also claimed there were malpractices during the voting process and that returning officers] were harassed.
The judge noted: “These are serious allegations bordering on criminal incidents yet they have not been proven.”
Ojaamong, the third respondent in the case, was declared winner of the August 8, 2017 polls with 135,962 votes against Paul Otuoma’s 125,165. The total number of valid votes cast was 275,653.
Me I think there is something brewing with all these petitions been thrown out. Maybe to pave way for the big announcement of Babu Vs Muriithi petition.
The courts are ok. a few individual judges are corrupt. like muchelule throwing out wavinyas case inspite of all the evidence tabled, kauras case, minji bae cried till ozband intervened.
Judge Sergon has ordered a recount of the mp votes in Embakasi East saying the petitioner has proved there were irregularities in the tallying exercise.
Interesting to see how this one goes.
A deterrent measure to stop disgruntled losers from wasting resources by rushing to court even when they don’t have a case, and poll riggers from thinking they will get away with rigging if their win is successfully petitioned.
