The civil society now claims Ethics and Antic-corruption Commission (EACC) boss Halakhe Waqo is the stumbling block in the ongoing investigation on the National Youth Service scandal. National Civil Society Congress (NCSC) yesterday said both the secretariat led by the Chief Executive Officer and the commissioners have no capacity to unravel the heated NYS saga to ensure justice. “What has Waqo ever done since getting to office? The chicken gate scandal, mileage allowances for members of parliament and now the NYS and no one has been made responsible. The former officer, who said he was employed as intelligence officer II in the department of Intelligence and Operations at EACC in January 2015, told the court in such cases he would be summoned by Mr Waqo and told to go slow or abandon the investigations. Among the cases he says he investigated and came across information linking Mr Waqo is the National Youth Service scandal of 2015/2016. The former officer said Mr Waqo played a major role in bringing the case to a premature end. He further said he later investigated and reported the fraudulent compensation of the Lamu coal power project in 2017. The court heard that when he tabled information linking a company by the name Dido and Sons Ltd to the scandal, he was told to stop the investigation. He said the company was being investigated for fraudulent compensation. The former officer also investigated a corruption case involving a two-year garbage collection contract where key government officers in Mombasa County were implicated, but again, he was told to drop the case, he told the court. Still in Mombasa, the former officer said he was stopped from investigating irregular employment at Kilindini Port. Mr Guracha said the sugar was brought in by two vessels - Georgios P and Skelt - which had 39,600 and 33,000 metric tonnes of sugar respectively. Documents submitted in court indicate Waqo pocketed Sh300 million proceeds of NYS, partly to conceal evidence about the masterminds of the heist, who were subsequently acquitted. Adan Guracha, the officer in Department of Intelligence and Operations at the Ethics and Anti-Corruption Commission (EACC) swore the affidavit in what highlights the depth of morass in the criminal justice system. As the lead detective in the scam, Guracha revealed he stumbled on sensitive information linking Waqo to the NYS scandal in 2015/16 in which he accuses him of bungling investigations. Details about Waqo’s alleged hand in the scam surfaced during an internal lifestyle audit in which he invested proceeds of NYS in a six-storey building in Isiolo Town.
