No one should be condemned unheard.
What makes the lawyers think that the arrested Ap’s are the only ones guilty. Such an operation involves a lot of people and planning. The 3 arrested were the ones manning the police post on the fateful day. Where are the ones who did the kidnapping, the ones who drove the taxi all the way to Limuru? Reports indicate phone signals of two of the victims are being traced to Kawangware and Bungoma. Where are the ones who sent or took the phones to those locations?

Said I won’t give my sentiments on this case ,hapa unaweza jikaranga ukuwe pia suspect.

even the state appointed counsels?

1. The plural of Counsel is Counsel.

2. As the name connotes, State Counsel work for the state as Prosecutors, Legal drafters, Registrars and all.

I know you are thinking about the Public Defender. There is no statutory body that provides legal aid for suspects who cannot afford it. Counsel are appointed by the State. They are the wakilis in town. They can choose to withhold their services and down the appointment .

I’m not a lawyer but won’t this be self defeating, will the case reach its logical conclusion, isn’t inadequate representation a sure way for the suspects to appeal or even if representation is afforded, could there be a mistrial due to the perceived bias and malice by the lawyers and to some extent judges.

1. Cases where suspects are not represented reach their logical conclusion - all the time.
2. The fact that you were not represented by Counsel CANNOT be the basis of a successful appeal.
   3.Cases are tried by Magistrates and Judges. Cases attract an uproar from one section of the public or another all the time [remember Mugo wa Gathoni and “Audrey Mbugua”?]. Unless it can be demonstrated - through evidence - that there was bias and malice, there will be no mistrial

In solidarity with their slain colleague-Lawyer Willie kimani,lawyers in the East African region should not offer any form of legal representation or legal service to the murderous trio.This should send a strong message the so called law enforcers who think they are above the law.

While the gut feeling is to want these devils denied protection, the professional code that lawyers and judges are sworn to uphold dictate that every suspect deserves representation, no matter how heinous their crime. Even serial murderers and mass bombers get lawyers.
