I think we have a problem of looking at the macro effects of these so called Romio and Juliet unions for lack of a better word.
I have lived in places where 12,13,14 year old girls are mothers. The same are the poorest of the poor. It’s difficult to find an upwardly mobile families become mothers at that age, awhile back a 9 year old gave birth. So if you get a child at ages 9-20 years old what happens? You drop out of school, you have alot of responsibility so you can’t study or concerate when maziwa inakuma, you have stress. I have seen this in high school and university. So what does that mean for the young lady, economic opportunities acquired through education.
So much as we may want to be easy on the 19 year old boy for getting his 17 year old girl friend. Let’s understand that at 19 you have alot responsibility because you are no longer considered a minor. If you take your dad’s care and you end up killing someone or you are fighting with your friend you kill them. The difference it makes if this happened when you were 17 or 19.
When you are 19 you are tried as an adult. You have adult responsibility, you are now a joint custodian of responsibility to uphold the laws of land bcz you are now an adult.
If you are in Gaza and you are 19 but your mbogi mates are 17. It does not look like a big deal but when you are charged with robbery with violence. The minors 17 years may be sent to approved schools and you you are sentenced to death.
So we are not denying that people are having sex but anybody under 25 is really not ready to handle the dire consequences of being sexually active. Even Benjamin Zulu says that anybody who is serious about their lives should not enter any relationship pre 25 bcz that’s when you are studying and beginning your career basically starting life and that’s where your mind needs to be not on a boyfriend or a girlfriend.
Sex is a burden. Even if you don’t get pregnant, you are burdened by emotional and psychological baggage. Furthermore when you are that age even the regulatory part of the brain is not fully developed. To me even a 25 year old woman is not ready for all the drama and for pregnancy and procuring abortions. Alot of problems you don’t need at that age.
So please let’s respect our children bcz when we as adults mess them up, we mess up our society. You can see what has happened in black American communities.
That will also automatically bubble over to all other matters of law…

Please let’s allow our young ladies to focus on education. Sex isn’t expiring it will be there even after they finish their studies.

These are basic things but humans always try to change God’s design yet God in His infinite wisdom created the human offspring as the most fragile in the animal kingdom even among mammals . As you know women can have about 20 kids at maximum reproduction but men produce billions of sperm in their lifetime. In some countries where infanticide of females was practiced women became so scarce that men started kidnapping women so as to have their genes propagated.
Don’t take everything I say as an attack against men, I have no problem with men the way you always think, the men in my life are extremely happy being in my life and those who didn’t deserve the great honor of having an amazing woman like me, the Good Lord sent them on their way before they could get near enough to turn my life into the hell I know most married women are going through, you see men have the biological advantages once you give a woman your kid in marriage or outside, you now have all the power to do anything you want to bcz you now have all the power and she has lost her power. I am an intellectual and I find myself thinking critically and academically of the phenomenon I observe in society.
Let’s not deviate from the topic which is why women or girls below 19 should not be having sex, the clear answer we can even get from the first world countries is that teenage and single mother hood is the highest predisposer to Poverty. So if you follow anywhere where young women or girls are having children outside of marriage before they complete their school you can rest assured that they will likely be poorer than the ones who avoid sex till marriage. Also their children have less time with their mothers, what they call latch key kids. Studies are there even on outcomes of kids born to teen moms or younger moms or single moms. So the effect is transgenerational. I will follow up on the girls who got pregnant during lockdown bcz they’re about 100k and you will feel the impact in 20 years to come for those who fell victim to the Corona babies misfortune.
So when Said Chitembwa I don’t think he deserves a title of a judge bcz his reasoning is very micro like you can expect from a watchman not someone bequeathed with a responsibility to safeguard society. So Mr. Chitembwa talking about a 14 year old girl who an adult of 24 years was molesting for 3 years meaning he started having sex with her at age 11,going to have sex with the man of her own volition doesn’t negate the fact that she is not capable of giving consent bcz she’s a minor. If a 24 year old woman is approached by a minor even 17 yes boy, if she accepts his advances, she will still go to jail, regardless of how much the boy pursued her bcz the boy even at 17 is incapable of giving consent as an adult male would do.
Its very scary to imagine that these are the caliber of people we have as senior magistrates in our country. I need to do a separate post on this.
