If civilized human society is to exist, the ultimate punishment must be applied for the most egregious crimes i.e. crimes against the state (treason, sedition, sabotage, espionage, and terrorism) and crimes against persons (murder, rape, assault). There is a problem of course in ensuring that convicted persons are indeed guilty, but that is another argument.
