Under the Sexual Offences Act, Section 11 (2):

Section 11(1):
11.(1) Any person who commits an indecent act with a child is guilty of the offence of committing an indecent act with a child and is liable upon conviction to imprisonment for a term of not less than ten years.

QUESTION
Using the song as an example: as a man, can you go to the Kenya Police and accuse the woman under Section 11(2).
A friend did that, Police told him we will catch and you will rot in jail.

What would you do?

Also note, Section 38 of the Sexual Offences Act states:-
Any person who makes false allegations against another person to the effect that the person has committed an offence under this Act is guilty of an offence and shall be liable to punishment equal to that for the offence complained of.

Section 38 of the Sexual offences Act, 2006 was repealed by statute (Miscellaneous Law) Amendment Act, 2012).

Why was it repealed.

Why is it a man cannot fo and say, “This woman, lied to me she was under 18. Infact she was even working in the bar.”

Why it was repealed? The skewed thinking that Section 38 discouraged the reporting of offences and that it criminalised and penalized complainants harshly in the event the complaint could not be proved, despite there existing penalties for perjury. That is simply not true and there were no proven cases to support that ridiculous assertion.

If you read the Sexual Offences Act you will realise that unlike other offences, a conviction for a sexual offence will ruin your life. Not only will you go to prison, your name and personal details will be placed in a register of sex offenders and it will stay there long after you serve your prison term. The entrance to your dwelling place must have a sign saying that you are a sex offender, you cannot even shift houses without notifying the local authorities etc. Maybe you can - but if you do and THEY catch up with you, there will be consequences.

People who make false accusations of sexual offences knowingly should be made to pay dearly. But the law says no. You can falsely accuse people of sexual offences and get away with it.

Where I reside (uku kwa mashamba), it is very common for The Working Population (Men) to be caught by the police for Sexual Offences Act (there are no crazy police cases: murder, theft, rape, etc). The Administration Police are hard at ‘Work’ catching Men using the Sexual Offences Act.
Also, in the rural area, a 16 to 18-year-old will act and do chores as a full-grown woman. Unlike in the city! You will go to the bar and find a very young woman, working as the village bartender.

But, as a man, you cannot go to the Kenya Police for it to be recorded in the Occurence Book and say, “I made a mistake. I had sex with a woman who works at Bar X and I have just come to find out that She is not yet 18 years old.” Even after Section 11A making it illegal for a under 18 to knowingly perform the act, partner with the Kenya Police to harass and steal from the Man!

Hahaha, jana kwa kinyozi I heard a story along hii theme ya under 18. A dude aliingia local yao akakatia kadame mgeni hapo. Wakaishia home, kuta vitu etc. Sasa, huyo dame alijiexcuse kiasi vile waliamka, akapiga simu. A few mins later wakadandiwa na makarao. Si kaschana kaliruka huyo msee. Ati hajawahi kunywa pombe, huyu mzee alimlewesha ata hakumbuki alifika hapo aje na ati ako highschool… Huyo msee aliingia cell 2 days akatoboka 150k. True story kabisa!
