A video of Central Organisation of Trade Union (COTU) boss, Francis Atwoli predicting former Prime Minister Raila Odinga unlawfully declaring a holiday resurfaced on Friday, March 17, days after his prediction came to pass.

In the video captured on October 26, 2020, during the Building Bridges Initiative (BBI) launch, Atwoli indicated that the former premier was among the few politicians who had the guts to declare a public holiday.

He noted that the ODM boss had a huge following and would be able to influence the country’s operations if he declared a holiday.

Atwoli added that only the late Kenneth Matiba and Raila wielded such powers.

"Raila is among the few Kenyans, and I can say that he is the only one after the Late Kenneth Matiba who can give a holiday outside the government-gazetted ones…If he says that people should not go to work and go to Uhuru park, he does not need facilitation, and that venue will be full," he stated.

The video of Atwoli emerged days after Raila unlawfully declared Monday, March 20, a public holiday.

According to Raila, the holiday would enable them to hold their mass action against President William Ruto’s government.

Since the emergence of the video, Kenyans opined on Atwoli’s prediction, which passed barely two years after his remarks.

Legally, Raila does not have the power to declare a public holiday. According to the Public Holidays Act, only the Interior Cabinet Secretary can gazette a public holiday.

“The Minister may at any time if he thinks fit, by notice in the Gazette, declare any day to be a public holiday either in addition to the days mentioned in the Schedule or in substitution for any of those days and either throughout Kenya,” reads the Act in part.

Notably, the Ministry of Interior refuted reports that CS Kithure Kindiki had gazetted March 20 as a holiday after a fake Gazette notice emerged online.

Meanwhile, Ruto advised his arch-rival to work with the Interior CS and the police to ensure that the March 20 demonstration does not turn violent.

“It is your responsibility to work with the police to ensure that for the rest of the citizens in Kenya, their lives are not disrupted their property is not destroyed and their businesses are not affected and they can go to work, you can carry out demonstrations,” the President stated.

Ministry of Interior on Friday, March 17, flagged a viral Gazette Notice that purported to declare Monday as a Public Holiday.

The gazette notice was alleged to have been signed by Interior CS, Kithure Kindiki, in line with former Prime Minister, Raila Odinga’s, mass action declaration.
Kenyans were thus allegedly granted the holiday to attend the mass action called by Azimio La Umoja.

“It is notified for general information that in the exercise of the powers conferred by sections 3 as read with section 2 (2) of the Public Holidays Act (Cap. 110), the Cabinet Secretary for Interior and Co-ordination of National Government declares Monday, 20th March 2023 a public holiday marking Mass Action Day,” the fake notice claimed.

The Ministry reiterated that March 20, was a normal working day, contrary to the opposition’s demands.

In a joint interview with Mount Kenya vernacular Radio and TV stations, Deputy President Rigathi Gachagua noted that Raila has no power within the law to declare a Public Holiday.

While responding to Narc-Kenya Leader Martha Karua’s request for a Public Holiday, Raila, on Tuesday, March 14, noted that Azimio supporters were granted the chance to participate in the mass action.

“We ask you, your excellency, to declare that day [Monday, 20 March] a public holiday so we can get on with this matter [anti-govt demos]. We can’t have rigged elections year in, year out," Karua requested.

Raila immediately heeded Karua’s pleas, declaring, “I hereby now declare today in the name of Azimio la Umoja One Kenya Alliance Coalition that Monday the 20th of March will be a public holiday.”

His declaration of a Public Holiday drew mixed reactions from Kenyans, including the Prime Cabinet Secretary, Musalia Mudavadi, who asked employees to ignore Azimio La Umoja’s call for mass action.

“You cannot be walking around telling people you want somebody to observe the rule of law and you yourself are so blatantly breaking the same, giving fictitious declarations that have no legal basis,” Mudavadi stated.

Mudavadi urged Azimio La Umoja leaders to table their concerns through the right channels and build a nation anchored by the rule of law.

Naivasha Member of Parliament, Jayne Kihara, on Saturday, March 18, dared former President Uhuru Kenyatta to declare his stance on planned Azimio protests.

Speaking at Kianyaga High School in Kirinyaga County, during Deputy President Rigathi Gachagua’s homecoming, Kihara pressured Uhuru to clarify his involvement in the mass action calls.

She, however, reminded the former President of the implications of advocating for mass action following his ordeal at the International Criminal Court (ICC) in the Hague, Netherlands.

“We must tell Uhuru that if he is not in this part of these maandamanos, he should come out. We have heard him say that Raila is still his leader and his President,” Kihara stated.

“So what we are saying is that our former President, if you have a hand in these protests (maandamanos) come out! Come out and talk!” she insisted.

On the other hand, Kaba Methu, Nyandarua Senator, implored Gachagua to allow United Democratic Alliance (UDA) legislators to counter Azimio rallies.

“You should allow us one day to engage with Azimio legislators and debunk their push for nationwide protests,” Methu stated.
“If they speak about Raila only, that will be okay. If they do not recognise you as the deputy president, then the meeting will end,” the MP added in what the opposition may perceive as threats to their freedom of association and right to protest.

Azimio chief, Raila Odinga, already wrote to the police, asking them to provide security during the demonstrations.

However, the clamour to counter his rally was further advanced by UDA secretary general, Cleophas Malala, who also vowed to lead protestors to storm Raila’s Karen home.

Malala warned young people against being misused by political leaders to cause violence.

On Thursday, March 16, he threatened to mobilise government resources to deal with Raila like any other lawbreaker.

“Monday, March 20, will be a normal working day. There won’t be any holiday, whatsoever,” Malala noted.

The former Kakamega Senator wondered why President William Ruto had allowed Raila to challenge his authority.

“We will not allow Raila to destroy this economy which we are working on reviving from the pit it was left,” Malala argued.

He also explained that Raila’s demands were misplaced since the Kenya Kwanza government was already working on a number of initiatives to lower prices for basic commodities.

“President Ruto has initiated a number of programmes under the law to ensure that price of basic commodities is reduced. There is no need for a demonstration against a government that is working hard to sustain the economy,” Malala stated.

Malala spoke at Machakos University amphitheatre hall on Saturday, March 18, while addressing UDA delegates.

Meanwhile, at Gachagua’s homecoming at Kianyaga High School, UDA leaders dismissed Raila’s calls to reopen the servers.

They argued that the August 2022 General Elections met all the standards approved by Independent Electoral and Boundaries Commission (IEBC) and other international observers.

Their sentiments came hours after The Central Organization of Trade Unions (COTU), led by Francis Atwoli, called President William Ruto to extend an olive branch to Raila.

COTU insisted that a truce would solve the standoff between the government and the opposition.

“We appeal to both parties to engage in active dialogue and find a long-lasting solution that will promote economic development in the country," COTU deputy secretary general, Benson Okwaro stated.

Meanwhile, student leaders affiliated with Azimio La Umoja, were arrested on Saturday, March 18, while holding a press conference in one of Nairobi’s hotels.

Police accused the students of holding an illegal meeting to advise their followers before the Monday, March 20, demonstrations.

Detectives were said to have stormed the hotel before the presser could get underway.

Nearly 50 student leaders were handcuffed, with some bundled into waiting vans pending being charged and arraigned on Monday, March 20.

President William Ruto on Sunday, March 19, reiterated his claim that Azimio leader Raila Odinga took part in the failed 1982 coup.

Addressing a thanksgiving rally in Nandi County on Sunday, March 19, the Head of State stated the was not scared of Raila’s call for mass action, even though, he was ready to hold talks should Azimio change its approach.
"We know Raila so well, and he has never changed. He started pushing for mass action several years ago.

“He started planning for a coup against a legitimate government, and failed before resorting to mass action,” Ruto claimed.

Ruto claimed that Odinga was arm-twisting him to get a piece of the national cake as he had done before.

This hints at and gives credence to the rumor spreading last week claiming there was pressure on Ruto to drop hardliners around his regime and replace Gachagua with a more moderate GEMA without yielding to a Raila handshake… :rolleyes::rolleyes:

“He has a track record of using extra-constitutional means to seek leadership positions in the country…His strategies include attempting to stage a coup against a government that has been elected by the people and mass action that lead to the destruction of lives and property,” Ruto stated.

Ruto further claimed that Raila had for many years subjected the people of Nyanza to servitude, almost to the point of making them slaves.

Dr Ruto warned that Raila was making plans to ensure that chaos was widespread, and not only in his Nyanzs backyard.

“He rules over the people of Nyanza with an iron fist of threats and fear, almost to the point of converting them into his personal slaves,” Ruto claimed.

The Head of State assured Kenyans that their lives and property will be protected in accordance with the laws of the land.

Speaking in Nakuru County on Thursday, March 16, Raila noted that the President had been constantly tarnishing his name with allegations of the attempted coup in 1982 during the late President Daniel Moi’s era.

According to Raila, no evidence adduced before the court at the time implicated him in the planning or execution of the 1982 failed coup.

Raila explained that he was charged with treason and detained for six months but he was later released and the court cleared his name for lack of evidence.
“I was discharged from treason charges after the courts found out that there was no evidence linking me to the 1982 attempted coup. Ruto has spoiled my name and I am going to sue him for defamation,” Raila clarified.

The Azimio leader warned that he would be moving to court to sue President William Ruto for injuring his reputation with the defamatory remarks.

The Orange Democratic Movement (ODM) Party Leader further declared that he would not be cowed by the State to back down from the planned protest.

“We cannot be intimidated by William Ruto and Rigathi Gachagua. I want to tell them that I fought for the second liberation in this country.

The two cannot understand what I have gone through…I have been fighting for democracy and was put in detention for eight years when some of them were still breastfeeding,” he stated.

Meanwhile:

Deputy President Rigathi Gachagua on Sunday, March 19, pleaded with retired President Uhuru Kenyatta to speak to Azimio leader Raila Odinga to call off the planned mass action.

Speaking during an interdenominational service in Nandi County, Gachagua argued that Uhuru owed it to Kenyans given that he was the alleged cause of the high cost of living.

He remarked that Kenyans made the ex-head of state a king by electing him twice as president when he was not ripe for the job and asked him to return a favor.

"I know you demean us and think that we are nothing, which is okay. But please, I am begging you, within the few remaining hours, to look for your brother and tell him to stop that nonsense of telling people to come and destroy property.

“It is ungodly and cannot be acceptable in a normal society. We are asking this will all due respect and if he grants this request, we will have no problem with him,” Gachagua remarked.

The outspoken DP further dragged Uhuru’s family into the tiff between the Kenya Kwanza government and Azimio.

“How ungrateful can you be with your brother to fund Azimio to create chaos in Nairobi yet you have so much property? What do you have against poor people and the little that they have?” Gachagua claimed.

Meanwhile, he warned President Ruto against succumbing to Odinga’s demands stating that if he entered into any handshake, then the Head of State would be answerable to him.

On his part, the Head of State maintained that he would not bend backward to negotiate with leaders who resorted to using blackmail to have issues addressed.

Ruto clarified that for him to have a sit down with any leader, he would have to do it within the confines of the Constitution. Nonetheless, he maintained that the police will do their work on March 20.

Earlier, Nairobi County Police Commander Adamson Bungei declared the planned mass action illegal, maintaining that Azimio did not follow due process.

However, Odinga rubbished the claims and shared a letter the coalition wrote to the police boss notifying him of peaceful protests in the Nairobi Metropolitan area.

Azimio leader Raila Odinga announced that his coalition will be holding protests across the country every Monday of the week.

Speaking to the media on Monday, March 20, in Eastleigh, Raila maintained that he will not be held back even as President William Ruto resorts to the use of force.

His declaration came after his convoy was teargassed while leaving Serena Hotel for a planned conference with his supporters.

“We stated that today was a public holiday to allow us to protest. We have started a war. Every Monday, we will be protesting, are we in agreement?..A war has started and it will not end until Kenyans get what they rightfully deserve,” Raila declared.

Further, Raila stated that he would report President William Ruto to the Internation Criminal Court (ICC) for the unconstitutional arrest of protestors and other leaders…

"We are protesting so that the cost of living can go down but Ruto has decided to arrest our people and beat them We will report him to the ICC,” Raila added,

Moreover, Wiper leader Kalonzo Musyoka reiterated that President William Ruto had not followed the law as provided by the constitution, which allows for peaceful protests.

“Kenyans will not allow anyone to act against the constitution. We have also demanded that the leaders who have been arrested against the law and taken to Kiambu Road should be released immediately,” Kalonzo stated.

Other leaders present included Narc Kenya leader Martha Karua, Wiper leader Kalonzo Musyoka, Raila’s daughter Winnie Odinga and DAPK party leader Eugene Wamalwa.

Kilifi Senator Stewart Madzayo was arrested by police officers at Nairobi CBD on Monday, March 20, 2023.

At Serena Hotel, the opposition leader’s motorcade was sprayed with water from the GSU water canon.

Additionally, the Police officers lobbed teargas at the protestors and Raila Oding’as convoy forcing them to exit the State House road and head towards Kamukunji where he urged his supporters to carry on with the protests.

Earlier in the day, police officers arrested a group of protesters and Azimio leaders including National Assembly Minority Leader Opiyo Wandayi and Kilifi Senator Stewart Madzayo.

Azimio Members of Parliament on Monday, March 20, lamented that the government had withdrawn their personal security detail during the planned mass action protest.

Speaking outside Parliament Buildings, Nominated MP Nyakerario Mayaka noted that the members of the public would defend them during the running battles with police nevertheless.

She urged Kenyans to rally behind their cause in a bid to petition the government to lower the cost of living.

“Even if you withdraw all our security, the public will protect us and we will all fight for things that affect Kenyans. Secondly, they stated that when Raila declared that Monday should be a holiday, he should have done a Gazette notice…Raila himself is a human Gazette notice. If he says today is a day that we are out there fighting for Kenyans for the things they deserve and we are out there. Let us join hands and fight for this country,” she stated.

Nairobi Senator Edwin Sifuna echoed her sentiments and added that the police disrupted what was initially scheduled to be peaceful demonstrations across the country.

“We have received reports of successful demos in every part of the country. What we want to condemn is the interference of police in the exercise of what is a Constitutional right. Our maandamano was scheduled to be peaceful but we have been assaulted, and arrested.”

“If you look at me, you will notice that I’m wearing a different shirt because they tried to arrest me personally. They tried to strangle me in the streets and he went away with my blue t-shirt, I want it back,” Sifuna stated.

Suna East MP Junet Mohamed, who was initially denied access to KICC, urged Azimio supporters to expect more demonstrations in the coming weeks.

“They are using taxpayers’ money. Today was just a rehearsal, the real one is coming,” the legislator stated.

“I want to condemn the arbitrary arrest of our leaders. As we speak, (National Assembly Minority leader Opiyo) Wandayi has been taken to Kiambu and we don’t know what they want to do with him,” Embakasi East MP Babu Owino corroborated.

Suba North MP Millie Odhiambo, who was in attendance, also lamented that she was denied entry to Central Police Station to visit her clients, National Assembly Minority leader Opiyo Wandayi and Senate Minority Leader Stewart Madzayo, who are in police custody.

"We don’t want and will not allow a dictatorship in this country. I sat with Ruto in the Parliamentary Select Committee and he is the one who moved the amendment to Article 37 of the Constitution that allows picketing. We want to tell him that we will neither tire nor relent and we will continue.

“Everybody has a right to legal counsel. I rushed to Central police station and was denied entry as their legal counsel. What do they think lawyers go to school to do? We will still push on and continue,” she stated.

Deputy President Rigathi Gachagua on Monday, March 20 revealed that the Azimio mass protests that paralyzed businesses in various towns across the country cost the Kenya Kwanza government Ksh2 billion.

Speaking while receiving relief food at the Mombasa Port, Gachagua explained that the money was lost because of the closure of businesses within the Nairobi Central Business District (CBD).

He explained that entrepreneurs closed shops after earlier declarations by Azimio protestors.

"Quite a number of entrepreneurs did not open their shops and businesses in the Nairobi CBD due to fear of looting and destruction of property.

“As a result of lack of business, the country has lost almost Ksh2 billion - money that should have been circulated in the economy,” Gachagua reiterated.

The DP claimed that the mass action could cripple the economy that was slowly recovering - a move he argued negatively affected Kenya’s reputation with international investors.

“We were getting a lot of affirmation from international financial players and all other partners but the events that took place today is not good for the progress,” he added.

He pleaded with Azimio to consider the mass action not only today but also several others in the pipeline for the forthcoming weeks and asked Kenyans to ignore the calls for demonstrations.

Subsequently, he announced that President William Ruto had issued an order to the Inspector General of Police Japhet Koome to restore normalcy in the CBD

Gachagua reiterated his call to have Azimio principals ask their children to be at the forefront of mass action instead of using others to pursue selfish interests.

Raila is yet to make a public appearance at the agreed meeting point. However, he was meeting Azimio leaders at a hotel in Nairobi.

An attempt by the leaders to address the media was thwarted by a contingent of police officers who lobbed teargas canisters at Odinga’s convoy.

Peaceful Kenyans have successfully arrested one rioting police officer.
