Its very hard to prove a crime in such a scenario. One ,our peno-code does not have such offences. Two, if you try to charge him with murder, the elements of the offence cannot be proved here. Third, if you accuse him of lets say negligence which caused the deaths, it will also be hard to prove because he was not the contractor or the masons involved in the construction of the building. Basically its a very convoluted situation and it can only be cured by parliament enacting an act describing these offences and clarifying the elements required to prove such an offence. Unfortunately Mr. Kamau will walk free.
