If wives default tax, husbands are liable!

The tax liability of a woman, living with her husband, is borne by the husband unless the woman opts to file a separate return which is optional. Separate returns are only to women not living with their husbands or separated under a court order. This leaves the man under the mercy of his wife. Where an amount of tax remains unpaid after the due date, a penalty of 20% shall immediately become due and payable by non other than the husband, according to Income Tax Act.
However, where a woman is employed, the risk is minimal as the onus to submit her taxes lies with her employer. Trouble is where the married woman is self-employed or earning professional income and does not pay taxes.

This has been in the Act since immemorial but KRA has to get ways to meet its targets.

Relax bana. The law is not targetting men. It’s merely an archaic law written during the time when women were considered men’s property. If anything, it demeans women.

This law was probably drafted, and published by men.
