He hasn’t tendered anyone since he’s not governor yet. So he’s just using his Sonko rescue team to start them job but his Sonko rescue team will become an independent unit just for the county meaning that cleaning tenders will stop being awarded and everything will be done in house.

Oh boy! Ever heard of Public Procurement regulations? You just can’t award a tender to anybody, there are procedures (competitive bidding and value for money). Many have perfected the act of fixing tenders by having related firms bid for the same job. Heck! While at it, why not have Mungiki as an inhouse unit. As someone has said above, Sonko will be bogged by lots of bureaucracy.

What does the law say, about those comtractors that fail to deliver goods and services as per contract?

Many who were rooting for Kidero still imagine that Sonko will fail. They will be disappointed when Sonko turns out to do a better job than the former govana. Donge?

Depends on nature of contract. Liquidated damages(works) and forfeiture of performance bond. You can’t be paid for not having delivered goods or services. So merchant stands to lose for failing to deliver. If by good/bad luck merchant had been paid, then whoever was authorised the payment will be in trouble since no goods/services were provided.

The law is clear on when Direct procurement/single sourcing can be used. Garbage collection doesn’t meet the threshold. The “Vijana” need to register and compete with other “Vijana”. Remember 30% of government procurement is reserved for youth and women. He can state that garbage collection is reserved for the youth.

Sonko has the goodwill of the people, let him use it well. Igathe to take care of the bureaucracy and the paperwork. Also hoping Sonko has enough MCAs to back him in the County Assembly. Opposition might want him to fail by sabotaging legislation on fiscal matters.
