The cases are always necessary. Police in Kenya are usually right. But senior officers get adulterated along the way to throw away cases. So they present weak evidence. Extremely rare to find someone charged with a crime he didn’t commit.

Then, the pretrial court work would be evaluating all the evidence, making sure the cases are solid before forwarding them to court.
Once the full trail starts, anyone trying to water down the case should be ready to answer some hard questions.
A good example of the case we are trying to avoid, is that of Okemo and Gichuru case, the debacle started in the first term of Kibaki Presidency, and was dropped 15yrs down the line.
Let the pretrial court iron everything, and once the case starts, it goes nonstop, for there will be no reason for adjournment.

I think you are misunderstanding the purpose of a pre-trial. It’s purpose is not to weigh the strength of evidence. Pretrial just checks is there’s evidence. Otherwise you are already holding a trial. 5-10 minute process. Which judges do anyway.
Gichuru and Okemo paid their way. They forfeited their funds in those British Isles.

They didn’t pursue anything. They just used their clout to send a message. Trust me if they pursued, those two would be in prison gowns at HM Belmash prison in London.
