2. He took massive performance risk
He says he kept injecting money, even draining savings and business cashflow, to finish the supply.
That means he carried execution risk before securing repayment.
3. Authority was informal, not public-facing
He says he had consent from the company and could prove the directors knew him. But public procurement officers care about formal authority, not “everyone knows me.” If you are not a director/shareholder/signatory on the visible paperwork, that becomes a weapon against you later.
The real mistake was confusing an economic interest with a legal right.
Economically, he may have been the one carrying the project.
Legally, the county seems to have viewed him as an outsider to the contract.
That gap is where the whole thing broke.
A safer structure would have included:
- a formal loan agreement or financing agreement with the company
- a board resolution authorizing him
- signed authority for him to act on the matter
- personal guarantees from directors/owners
- a lawful assignment of receivables or acknowledgment of payment flow
- a clause saying no more funding after X amount
- proof of budget/payment status before full performance
- staged delivery tied to staged payment
Without protections like that, he was basically saying:
“I will bear most of the cost now, and trust that formal recognition will sort itself out later.”

This is something I tell people about tendering and they never believe. Even the connected guys still get scammed because of the many decision makers in the process. Plus there are so many people who go in to the tender as relatives and friends, yet there is only one slot to be given the prize. I have seen even the son of a minister get taken round in circles. Gava money is high risk, high reward, pure gambling on many levels, don’t let anyone ever sell you guarantees around it
You know nothing young man. People who are in the system will tell you the money with the most delays and defaults is the one which goes through the formal channels. In the Kenya government if you want a reliable payment, it will be one where the money has already been stolen by a decision maker, then that decision maker pays you directly in cash. That’s the only way to take out the thieving intermediaries who make contractor cash disappear. If you see a government project going on smoothly in Kenya, just know everyone there is being paid with gunias and bahashas of cash
