If you’re an advocate, it’s unethical to refuse to represent a client – unless there is a justifiable reason.
It’s the same way doctors have an obligation to treat all individuals under their expertise without any personal bias – even if Hitler came to the hospital.
However, nobody will tell you this, sometimes lawyers represent clients while deep down they’re rooting for the victim. No lawyer will admit it!
In such cases, the lawyer will just take your case out of obligation – but he/she doesn’t care what will happen to you. Atakula tu pesa zako bure.
I think Dj Faxto’s advocate is one of those people. No serious lawyer will let his client do a press conference and contradict himself. Also, Dj Faxto’s made statements that could be used against him in court to question his credibility.
It’s either the lawyer is incompetent or he’s secretly rooting for the victim. Either way, he will get paid regardless of the outcome of the case.
Mtu aliadvice DJ Fatxo afanye press conference alikosea. Dude was just contradicting himself all through. With all that people now know he was somehow involved.
You can. Remember Cliff Ombeta and Mugo wa Wairimu case? Ombeta had to back off from representing him for a second time since he didnt want the wrath of women and also since he himself wanted justice for the aggrieved party.
You wont know since you are busy masturbating in your stuffy bedsitter in Kariobangi.
I know that since Ombeta himself said it loud in the media but then you wont know that since you turned your hand into a makeshift pussy you use to choke your 3inch dick to death.
For a lawyer to deny to represent a client due to conflict of interest, there must be a few grounds like personal relationship, financial interest, representation of another client with interest to your client, and professional obligation.
This means that if someone walks into your office after raping a 1 year old child to death, you cannot professionally refuse to represent that client because of the nature of the crime. Unless you can give a valid reason and claim conflict of interest. Although you can refer that client to another lawyer if you don’t specialize in that area.
In fact, it’s not your job to know whether that client is guilty or not. That’s up to the court to decide.
But I’ve seen cases where people went to prison because their lawyers didn’t care. The lawyers took the case, but they were so incompetent you would think they secretly want the client to be found guilty and sentenced. But you can’t prove it.
now, rather than insulting me, what would have been easier than to bring the actual clip here so that I see it. You might have misinterpreted the whole thing ama wewe ni omniscient? :D:D
I think I know what he means. Rooting for the client na huko ndani na hakwambii. It shows in the advice given…like in this case. Whoever told DJ Fatxo to address the nation/bloggers alimtupa sana. BTW let me give you another egzabo. When we have immigration cases out here kwa wenyewe…we are often advised to scrutinise our lawyers very closely…you could very easily fall in the hands of one who is representing you but na huko ndani yake is not representing you…and is wishing you could be deported asap.
I am just rambling on…
