Congratulations Kenya

Kenya has finally gotten a chance to have one of her own at the ICJ following resignation of the Somalian judge a Mr Yusuf.

Previously,Kenya always cited the presence of Mr Yusuf at the ICJ as one of the reasons Somalia never adhered to the 2009 MoU but quickly rushed to the court. Kenya always did everything to get the case delayed ensuring the case was always postponed, from around 2014 to 2021.

Eventually, when ICJ delivered it’s verdict in 2021, Kenya rejected it in totality terming the judgement unfair, biased and not recognized by Kenya.

A part of the rulling noted that in the absence of a certain Somalian piece of legislation,it is unable to determine the nature of a certain line which is implied to be the Kenya somalia maritime boundary. Somalia maintained her stand that, that piece of legislation got lost!!!

On the other hand, Mr Yusuf wrote a dissenting opinion opining that the court has given a rulling which is a potential source of dispute between Kenya and Somalia by resulting into a grey zones where somalia has jurisdiction over the water column while Kenya has jurisdiction over the sea bed.

That means Somalia and Kenya need to talk. Furthermore, in the 2009 MoU, Kenya wanted to talk to Somalia after consideration of her case by the Commission on the Limits of the Continental Shelf. That has happened finally, even though Somalia back then, quickly later on tried to disown that MoU and ran to the ICJ to settle ‘a maritime dispute’ between her and Kenya.

It is my opinion nothing is happening by accident but by design. Like the ministry of energy official map of oil blocks and the 10 most viable which were to be auctioned on October,but later postponed, Kenya navy patrols, arrests etc, Museveni noises, among many other things.

Judge Yusuf resigned because of his conduct in the Sudan UAE case among many other controversies. His term was to end in February 2027 but he opted to resign this early for reasons not publicly stated
