But from my very general understanding …
- Under the Constitution of Kenya (2010) , elections cannot be “cancelled” , but the term of Parliament can be extended if Kenya is at War with an external enemy.
- Resolution Requirement: Each House must pass a resolution supported by at least two-thirds of all its members.
- Duration of Extension: Parliament can extend its term by no more than six months at a time.
- Maximum Limit: The total extension cannot exceed 12 months.
The Independent Electoral and Boundaries Commission (IEBC) also has specific legal powers under the Elections Act (Section 55B) to postpone elections in specific areas or nationwide under certain conditions.
- A credible risk of a serious breach of peace.
- The impossibility of conducting elections due to a natural disaster.

If an election is postponed , the law mandates it must be held at the "earliest practicable time.
