Cops in the U.K. are asking victims of crimes, including those who allege rape, to hand over their phones for investigation or risk seeing their case dropped.
The requests will be made via consent forms that are being rolled out across forces in the U.K. The forms tell complainants that they can refuse to hand over their device, but it adds that refusing access could mean the end of the investigation or prosecution.

Reports have cited a previous investigation as providing the impetus for the new forms in which a British student, Liam Allan, was accused of rape. The charges were dropped after it emerged police had missed key evidence from a stash of 57,000 messages on the alleged victim’s mobile. London’s Metropolitan Police was forced into giving Allan an apology. In that case, the police had access to the alleged victim’s phone and the messages within. Rather than provide an impetus for additional access to victims’ devices, that investigation indicated that even when the police have all the evidence they need, sometimes they don’t use it effectively.

Troels Oerting, a lifelong police officer and former head of cybercrime at Europol, said that police will use many techniques to get the relevant data, but in some cases it was much easier and quicker to get information directly from a victim. But it shouldn’t be mandatory, he said. Only after an initial investigation revealed that there was a need to see the victim’s phone—such as when the accused provided messages indicating their innocence—should a request be made.
“That’s different to saying you need to provide us with all evidence before we investigate,” Oerting told Forbes. He warned of the potential for deterring victims from coming forward, adding, “I wouldn’t start by mistrusting the girl. … We should not in any way support a culture where the male is superior.”
