In the final remark Chief Justice Martha Koome told Kenyans their main priority:
“Provide a judgement that promotes the constitution which is anchored in the law and nurtures democracy, brings harmony to the country and every good contained in the constitution”
The Judges also told us they work as a team of equals with shared leaderships, perhaps indicating no one judge would dominate the judgement process.
We may second guess, the Judgement will come down to the Constitution. Were there any serious breaches upon any article of the constitution; if left unchallenged would it set a bad precedent, what would it’s implication be upon our democracy and how would it impact the harmonious existence of the citizens.
If the results are upheld, let all the people shake hands and move on to rebuilt trust.
However, if any article of the constitution is in question, it imparts on all levels of the election, there cannot be just a re-run but nullification of the entire election.
When all things are considered one item stands out as an issue of serious concern - There is no election anywhere in the known world that has ever been conducted with the presence of duplicate forms as for 1 & 2 both active in the same election and 50% of which could not be accounted for in the sample re-count.
We may just ask, what would stop future commissioners from printing excess ballot papers and distributing them out as they so desire.

the pointer is in the way the judges were asking questions, it wasn’t a matter of eloquence or coherence as some here would love us to believe, the matters are simple, were their breaches and contraventions of the constitution ?

Nullifying is a waste of time and resources, ruto has already started getting support from azimio politicians. The second one will be a humiliating defeat, also remember raila had the support of deep state and those four commissioners were unlawfully appointed to serve deep state.
