Chebukati is the Returning Officer of the Presidential results, but that doesn’t give him the mandate to tally and verify the results alone.
It’s like how in a jury court of law, the jury can decide who is guilty or not guilty, but it’s the judge who can declare the verdict.
The IEBC set up is structured in a similar way. Chebukati’s role is oversight and declaration of the president elect, but he can’t declare the winner without a consensus from the committee.

Even at the polling station, the law is that the Commission shall tally, verify and announce results. So the commission is everyone hired by the IEBC.
Of all the commissioners, only Chebukati has a defined role in the tallying, verifying, and announcement of the results.
The announcement of verified results is at the Chairman’s discretion. If he’s satisfied that the remaining constituencies can’t overturn an election, then he can declare the winner too.
